DMCA Copyright Policy

HelpVote respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which may be found on the U.S. Copyright Office website at copyright.gov/legislation/dmca.pdf, HelpVote will respond expeditiously to claims of copyright infringement committed using the HelpVote service and/or the HelpVote website (the "Service") that are reported to HelpVote's Designated Copyright Agent, identified below.

1. Notification of Copyright Infringement

If you are a copyright owner, or authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement through the Service, please submit a written notice ("DMCA Notice") containing ALL of the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or if multiple works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed — including the URL or a description sufficient to enable HelpVote to locate the material (e.g. the post ID shown in the app).
  4. Information reasonably sufficient to permit HelpVote to contact you, such as an address, telephone number, and, if available, an email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. What We Do After Receiving a Notice

Upon receipt of a valid DMCA Notice, we will expeditiously remove or disable access to the allegedly infringing material and notify the user who posted it. We reserve the right to terminate the accounts of users who repeatedly infringe copyrighted works.

3. Counter-Notification

If you believe your content was removed in error, you may submit a written counter-notification containing ALL of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location at which the material appeared before it was removed.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address, telephone number, and an email address where you may be contacted.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, for any judicial district in which HelpVote may be found, and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.

4. Repeat Infringers

In accordance with the DMCA and other applicable law, HelpVote has adopted a policy of terminating, in appropriate circumstances and at HelpVote's sole discretion, users who are deemed to be repeat infringers. HelpVote may also, at its sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

5. Misrepresentations

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
